At Brgy. Penafrancia, Del Gallego, Camarines Sur, at about 4:30 AM, Friday, November 11, 2016 suspected drug traders, Punong Barangay Oriel Degrano Legazpi (True name: Jose Oriel Degrano Legaspi) of legal age, married, resident of Brgy.Peñafrancia, Del Gallego,Camarines Sur. who escaped, while Orly Degrano Legazpi, of legal age,married of Brgy. Peñafrancia, Del Gallego, Camarines Sur was killed by the PNPoperatives after the service of Search Warrant for illegal drug.
Elements from PAIDSOTF, PIB, CSPPO CSPPSC, RIU and Del Gallego MPS led by PSINSP RYAN M BAGASALA implemented Search Warrant No. T-2016-194, for Violation of RA 9165 and Search Warrant No. T-2016-195, issued by Hon. Judge Alben Casimiro Rabe of RTC Br 15, Tabaco City dated November 8, 2016 against the suspects.
At about 6:30 AM of same date, Team One led by PSINSP RYAN M BAGASALA initiated the conduct of searching in the presence of Brgy. Kagawad Jackelyn P Mondigo, Media representative, Hero Peewee C. Bacuño, of GMA 7, and the wife of Plaintiff, Mrs. Melba Verdejo Legaspi at their resident, Brgy. Peñafrancia, Del Gallego, Camarines Sur, and following pieces of evidence were recovered/confiscated:
1. Eight (8) pcs small size heat-sealed transparent plastic sachets, containing suspected shabu; and
2. One (1) pc live ammunition for M-16, attached with paper tape
Marking,inventory and photograph of pieces of evidence was made at aforesaid resident in the presence of witnesses and the wife of Punong Barangay Jose Oriel D Legaspi.
Likewise reported, that at about 4:58 AM of November 11, 2016, same teams led by PCINSP PAUL DM CABUG, Intel Officer of PIB, CSPPO also implemented Search Warrant No. T-2016-196 for Violation of RA 9165 and Search Warrant No. T-2016-197, for Violation of RA 10591 issued by Hon Judge Alben Casimiro Rabe, dated November 8, 2016 against Orly Degrano Legaspi at BrgyPeñafranca, Del Gallego, Camarines Sur.
However, prior to the search, ORLY DEGRANO LEGAZPI, was killed after the latter took his firearm in his room and aimed to the raiding policemen.
The SOCO team after conducting of crime scene processing recovered One (1) suspected Caliber 45 NORINCO PISTOL with Serial Number BA 20689-09-246 with chamber loaded One (1) Caliber 45 Live Ammunition and with Magazine Inserted loaded with six (6) Caliber 45 Live Ammunitions; Three (3) suspected 9MM Fired Cartridge Cases; and One (1) Jacketed Fired Bullet. However, the searching team had overlooked to conduct the search at the residence of the subject due to high tension of the relatives of the subject who was gunned down by the raiding team, and that imminent danger on the part of searching team may exist.
Recovered pieces of evidence were properly turned-over to PCLO for proper disposition.
